2. Text Message Consent

1. By using the Service(s), you grant zPaper the express permission to send text messages via short message service (“SMS”).

   Purpose. These messages are sent to enhance your ability to use the Service(s), including, but not limited to, facilitating authentication, reminders, product notifications, sharing data with your Care Circle or status updates.

   Costs. You are solely responsible for any messaging or data rates imposed by your mobile carrier. Standard message and data rates may apply.

   Indemnity. You represent that you have the right to send messages to any recipient identified by you and will indemnify zPaper, its officers, and advisors against claims arising from unauthorized messages. This obligation survives any opt-out from SMS communications.

2. Opt-Out Mechanism. You may opt out of SMS communications at any time by:
   1. Replying “STOP” to any SMS message from the Service(s).
   2. Contacting zPaper Customer Support by calling (845) 2HEALTH or (845) 243-2584 or sending an email to zPaper Customer Support at support@healthscores.ai. When communicating with zPaper, you will need to provide your email, full name as registered with HealthScores.ai, and the email address associated with your HealthScores.ai account.
   3. Disabling SMS notifications in your account settings (if applicable).
3. Effect of Opt-Out. Opting out may limit certain functionality that relies on SMS verification or notifications. You also acknowledge that opting out of SMS communications may affect your ability to receive certain information from HealthScores.ai.
4. Re-Consent: You may re-enable SMS communications by replying “START” to our SMS number or by contacting zPaper Customer Support as indicated above.

3. Electronic Signature and Notices Consent

1. Consent to use Electronic Signatures. By using the Service(s), you agree to the use of electronic signatures. You further agree that your use of a keypad, mouse or other device to provide agreement, acknowledgement or consent constitutes your signature (“E-Signature”), acceptance, and agreement as if actually signed by you, in writing. You also agree that no certification authority or other third-party verification is needed to validate your E-Signature and that the lack of such certification or verification will not in any way affect the enforceability of your E-Signature. Any documents signed by you will be available to download and print during and immediately after the signing session.
2. Consent to Receive Electronic Notices and Disclosures. By using the Service(s), you agree to receive electronic notices, disclosures, authorizations, acknowledgments, and other documents from zPaper as may be required by law (“E-Notices”). You also agree that zPaper is not required to provide you with additional paper (non-electronic) copies of any notices or disclosures.
3. Opt-Out Mechanism. You may withdraw your consent to use E-Signatures and E-Notices at any time by:
   1. Contacting zPaper Customer Support by calling (845) 2HEALTH or (845) 243-2584 or sending an email to zPaper Customer Support at support@healthscores.ai. When communicating with zPaper, you will need to provide your email, full name as registered with HealthScores.ai, and the email address associated with your HealthScores.ai account.
   2. Declining to sign a document during a signing session and acknowledging that you desire to withdraw consent to E-Signatures.
   Any withdrawal of your consent to E-Signatures or E-Notices will be effective only after zPaper has had a reasonable amount of time to process your request.
4. Effect of Opt-Out of E-Signatures. Opting out may limit certain functionality that relies on E-Signatures and will terminate your ability to provide electronic signatures on documents. Continuing to provide E-Signatures after withdrawing consent is reaffirmation of your consent to use electronic signatures under the E-SIGN Act.
5. Effect of Opt-Out of E-Notices. Opting out will terminate your ability to receive E-Notices. If you decide that you would like to resume the receipt of E-Notices, please contact zPaper Customer Support by calling (845) 2HEALTH or (845) 243-2584 or sending an email to zPaper Customer Support at support@healthscores.ai. When communicating with zPaper, you will need to provide your email, full name as registered with HealthScores.ai, and the email address associated with your HealthScores.ai account.

4. Information We Collect

A. Personal Information

• Personal Identifiers:
  • The following identifiers are collected for you, the user of HealthScores.ai: Name (communication), email address (communication), phone number (communication), OAuth ID (access to website), credit card information (payment processing).
  • The following identifiers are collected for Care Circle Participants that you invite to your Healthscores.ai app: Name (communication), email address (communication)
  • Once a Care Circle Participant accesses HealthScores.ai and signs in, they will then become a user of HealthScores.ai and the personal identifiers in the first bullet point of this section will apply.
  • The following identifiers are collected for Practitioners using HealthScores.ai: Name (communication); email address (communication), phone number (communication), fax number (communication), address (communication), primary language (communication), and NPI number or EMS ID (access to website).
• Protected Classifications under California or federal law: None.
• Customer Records: Signatures (acknowledgments), FHIR URL (link to files)
• Biometric Data: Voice Print ID (access)
• Geolocation Data: IP Address (access)
• Professional or Job-related Information: NPI number or EMS ID (Practitioner's access to website).
• Internet Activity Data: Refresh tokens (access to website)
• Sensory Data: None.
• Educational Information: None.
• Inferences drawn from personal data that can be used to create a consumer profile: None.

B. Usage Data

• IP address, browser type, device identifiers, operating system, and activity logs.

C. Customer Content

• Personal Identifiers you upload into HealthScores.ai.
• HealthScores.ai does not permanently store, cache, or persist your health, medical and fitness records or data on our servers. Data not listed in paragraph 2.a is stored on your browser cache or a connected platform, which is managed by you.

D. Cookies & Tracking Technologies

• HealthScores.ai only uses essential cookies, pixels, and similar technologies to improve user experience, analyze usage, and deliver personalized content.
• If you do not wish for HealthScores.ai to use these essential cookies, please cease use of the application and delete it.

5. How We Use Your Information

We process your data for:

• Service Delivery: To operate, maintain, and improve our product, obtain required consents, and facilitate communications between third-party healthcare providers, as directed and consented to by you.
• Account Management: To process payments, manage subscriptions, and provide customer support.
• Security & Compliance: To detect fraud, prevent abuse, and comply with legal obligations.
• Marketing & Communication: Communications with you and your Care Circle Participants via text, email, fax, and direct messaging to send updates and product announcements (with your consent, where it is required to have such consent).

6. Sharing Your Information

We do not sell your personal data. We may share it with:

• Care Circle: You may elect to share access to certain information with:
  • Family members, friends, caregivers, and others (your “Care Circle Participants”); and
  • Healthcare providers and emergency services personnel (“Practitioners”).

Care Circle Participants and Practitioners are, collectively, “Care Circle”. Access to your HealthScores.ai information is based on your permissions and/or direction within HealthScores.ai.

After you send an invite to a potential Care Circle Participant, they will be required to create their own account within the app. Within HealthScores.ai, you can toggle a button “on” to allow a Care Circle Participant’s notification as your health condition changes and “off” to remove a Care Circle Participant’s access to that information.

Practitioners may initially access your health information by scanning a QR code printed on a sleeve that is attached to your smartwatch or by entering the phone number associated with your account. Practitioners will also have access to your health information stored in your personal document sharing application. Access to that health information may be controlled by you within that document sharing application itself.

IF YOU CHOOSE TO SHARE YOUR PERSONAL HEALTH INFORMATION WITH PRACTITIONERS USING HEALTHSCORES.AI, THAT SHARED INFORMATION MAY ALSO CONTAIN THE PERSONAL HEALTH INFORMATION, HEALTH HISTORY AND GENETIC INFORMATION OF MEMBERS OF YOUR FAMILY. WHILE HEALTHSCORES.AI DOES NOT REQUIRE YOU TO OBTAIN CONSENT FROM YOUR FAMILY MEMBERS BEFORE YOU SHARE THEIR PERSONAL HEALTH INFORMATION, HEALTH HISTORY AND/OR GENETIC INFORMATION WITH YOUR PRACTITIONERS, YOU SHOULD ONLY SHARE THIS ACCESS WITH PRACTITIONERS THAT YOU TRUST. ZPAPER IS NOT RESPONSIBLE FOR THE USE AND DISSEMINATION OF YOUR HEALTHCARE DATA BY YOUR CARE CIRCLE WHO ACCESS OR DOWNLOAD YOUR RECORDS OR DATA USING HEALTHSCORES.AI.

Legal guardians, in the case of a minor or incapacitated adult, and duly authorized representatives with consent or Power of Attorney (a “Member’s Representative”) may have access and edit privileges within HealthScores.ai for an individual. zPaper reserves the right to deny access to a Member’s Representative where state law does not allow for such access.

• Service Providers: Hosting, payment processors, healthcare providers, pharmacies, insurance providers, and customer support tools.
• Third-Party Integrations:
  • HealthScores.ai stores your Personal Information in our CRM and CRM associated cloud storage. Additionally, HealthScores.ai uses the zPaper Sprkz Viewer for .pdf management.
  • HealthScores.ai manages your documents that are stored in your Google Drive.
  • HealthScores.ai uses an IAL2-certified solution to authenticate your identity.
  • Additional third-party integrations may exist if you choose to connect HealthScores.ai to other services, such as: (e.g., Electronic Health Records systems (EHRs), Health Information Exchanges (HIEs), Qualified Health Information Networks (QHINs), Advance Directive Apps, Telemedicine Providers/Apps, Medical device apps, Google (Docs, Calendar, Health, Meet and Chat), Apple (Docs, Calendar, Health and Wallet), WhatsApp, MyDirectives A/D Vault Exchange, National Donate Life Registry, and other healthcare apps connected by the subscriber.
• Legal Authorities: When required by law or to protect rights and safety.

7. Data Retention

We retain personal data only as long as necessary for the purposes stated above or as required by law. Upon request, we will delete your data.

8. Security Measures (SOC 2)

zPaper implements SOC 2-compliant controls with HITRUST mapping, including:

• Data encryption in transit and at rest.

• Role-based access controls for zPaper employees.

• Continuous monitoring and incident response protocols.

9. Your Rights

Under CCPA (California Residents):

• Know what personal data we collect and how we use it.

• Request deletion of your personal data.

• Opt out of the sale or sharing of personal data.

• HealthScores.ai does not sell your personal data. To opt out of sharing your personal data, please use the controls within HealthScores.ai to remove Care Circle Participant access or account connectors.

10. Support

Users may make a complaint by submitting an email to privacy@healthscores.ai with a subject line entitled “Complaint.”

11. Cookie Policy

HealthScores.ai uses only essential cookies, which are required for platform functionality.

HealthScores.ai does not use analytics, marketing cookies, or other non-essential cookies.

12. Privacy Choices

Access or Update Account Information. You can review, change, and update your account information (name, email address) by logging into your account. We encourage you to maintain updated healthcare information as provided by your healthcare providers. You may reach out to your healthcare providers directly for any changes to your healthcare information. zPaper has no role in providing, editing, or updating your healthcare information.

Unsubscribe or Deactivate Account. You may unsubscribe from the Services or deactivate your account with zPaper by contacting zPaper at support@healthscores.ai or via the settings in your account. Upon termination, zPaper will end your access to the Services, but you will retain access to your healthcare information stored in your personal document sharing application. zPaper will retain only your account information (name, email address) as part of our historical records.


HealthScores.ai does not use analytics, marketing cookies, or other non-essential cookies.

13. Changes to This Policy

We may update this Privacy Policy periodically. Updates will be posted on this page with a revised effective date.
